TERMS & CONDITIONS
You (Client") and Tim Elwin Trading As urban Ripples ("Photographer") are entering into an agreement whereby the Client agrees to the below terms in exchange for photography services from the photographer.
AGREEMENT DETAILS

2. Entire Agreement
This agreement contains the entire understanding between the Client and the Photographer.
3. Confirmation
By booking this service, you accept the terms to this “Photography Agreement” on the date you selected in the booking system.
4. Co-operation
The Client and the Photographer consent to happily cooperating and communicating with each other to achieve the best possible result within the understanding of this agreement.
5. The Schedule
The photographer's shooting schedule, working style and experience are designed to achieve a great set of pictures for the Client. Both the Client and the Photographers therefore agree that punctuality and cooperation are essential to producing outstanding photographic results. In cases where the photoshoot does not run on time (for example, extreme lateness by one of the Client arriving to the venue), the Photographer cannot be held liable for a lack of photoshoot photos.
6. Usage
The Client is obtaining prints for personal use only, and shall not sell said prints or authorise any reproductions thereof by parties other than the Photographer. If Client is obtaining a print for reproduction, Photographer authorises the Client to reproduce the print only as set forth under Special Usage Requirements. In such event, Client shall request that a copyright and credit notice for the Photographer be placed adjacent to the photograph on publication. This clause applies to all social media.
7. Copyright
All photographic materials, such as original negatives, photos, or slides, shall be the exclusive property of the Photographer. The Photographer shall own the copyright in all images created and may use the work for samples, contests, exhibition, advertising and self-promotion. Usage outside the bounds of this agreement will require the Client’s consent.
8. Edit Requests
The Client accepts that as this is a free service, any edit requests on the images are at the Photographers full discretion.
All deliverable images as per agreement will have standard image editing (including: light skin retouch, light and colour adjustments). Any extra edits requested by the client will cost the client $35 per image if accepted by the Photographer. Extra image adjustments include (change the size of the body or parts of the body, skin lines, dark bags under eyes, change the colour of parts of the body, extra skin retouch, replace or swap background). It is also understood that unless hair and makeup is included in the contract, Photographer is not responsible to fix hair or skin, or makeup problems. It is understood that Photographer is not responsible to fix photos to cover parts of your body that you do not wish to be seen in the photo, unless it was confirmed with the photographer in writing.
9. Location Rules Note the Photographers are sometimes limited by rules imposed by management of the location, included but not limited to local councils, as to what can and cannot be done. In such circumstances the Client agree to accept the local management's rules and limitations that may be imposed on the equipment used. The Photographer advises the Client to make themselves aware of the rules of the venue concerned and if necessary, negotiate with the personnel concerned.
10. Liability
If a photographer is too ill or becomes injured and cannot supply the photoshoot services specified above the Photographer will attempt to book a replacement photoshoot photographer. If both the Client and Photographer agree, the date of the photoshoot can be amended to a new date. The Photographer has working methods in place to prevent loss or damage to your images. However, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons in or beyond the Photographers='s control. In these circumstances liability is limited to the return of fees paid for the service or part thereof prorated according to the percentage of images supplied.
By accepting these terms to a free photography session with Urban Ripples, I am hereby waiving, releasing, and discharging Urban Ripples and all its affiliates, from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me or my family including my traveling to and from this service. Urban Ripples is not responsible for any injuries inflicted upon any participating parties. You will be responsible for any other party you bring to shoot and release photographer from any claims against their person or their business. Client swears that each person is participating voluntarily in the said photography session and forfeit all right to bring any legal action against Urban Ripples for any reason.
